Toccoa man arrested after allegedly becoming aggressive during traffic stop

A Toccoa man was recently arrested by the Stephens County Sheriff’s Office following a traffic stop.

According to Stephens County Sheriff Randy Shirley, on December 3, around 5:00 a.m. a deputy with the Sheriff’s Office conducted a traffic stop on a red Volkswagen Jetta at the intersection of Liberty Hill and Mize Road.

The deputy, according to Shirley, could smell the distinct odor of marijuana coming from the vehicle as it drove in front of the deputy.

As the deputy approached the vehicle, he could still smell the odor of marijuana coming from inside the vehicle.

Shirley says the driver of the vehicle was asked to step out of the vehicle, which he complied with, but soon became argumentative and aggressive.

Due to the driver’s behavior, he was placed in handcuffs, which Shirley says, was for the safety of the driver and the deputy.

The driver continued to be aggressive, pulling away and kicking at the deputy while being placed in the back seat of the patrol car.

During a search of the vehicle, Shirley says, a Glock handgun and quantity of marijuana was recovered.

Shirley says, the driver, identified as 20-year-old Victor Nicely of Toccoa, was arrested and charged with obstructing or hindering law enforcement officers, possession of marijuana with intent to distribute, possession of a firearm to attempt to commit certain felonies, and possession and use of drug related objects.

Nicely is currently out on bond from the Stephens County Jail.
