Testimony continues today in lawsuit alleging voting irregularities in December 4 Special Primary

Testimony will continue today in the lawsuit filed by Dan Gasaway alleging numerous voting irregularities in the December 4 Special Primary.

Gasaway’s attorney rested his case after two days of calling witnesses and a GIS mapping expert.

Senior Superior Court Judge David Sweat told the court he would like to get through the hearing and wrap up testimony today.

Stephens County Attorney Brian Ranck tells WNEG News that according to Georgia law, if the judge decides in Gasaway’s favor, State Representative Chris Erwin, who won the Special Primary by two votes, would have to vacate the House District 28 seat, even though he has already taken the oath of office and a new, third election would have to be held.

The defense will begin calling their witnesses today and the attorneys for Banks County Sheriff Carlton Speed will call their witnesses on Friday and it will likely be next week before Judge Sweat renders his decision.
