Toccoa Man Free on Bond After Being Found Guilty of Child Molestation

A Toccoa man is free on bond, awaiting sentencing in Franklin County after being convicted last week of child molestation and other crimes.

Northern Judicial Circuit District Attorney Parks White said 50-year old Bobby Todd Jordan was found guilty Friday in Franklin County Superior Court in Carnesville.

Assistant District Attorney Jeffery Fogus argued the case for the State.

However, White said after the guilty verdict was read, Superior Court Judge Chris Phelps did not do what the Prosecution expected.

““After sentencing, Jeffrey moved to have him (Jordan) taken into custody pending sentencing,” White explained. “However, Superior Court Judge Chris Phelps allowed Bobby Todd Jordan to remain out on bond pending a pre-sentence investigative report.”

Jordan was indicted in March of 2012 on one count of felony child molestation, one count of felony false imprisonment and one count of felony sexual battery against a child under the age of 16.

The indictment stated the crimes took place at a residence on Bent Tree Circle in Toccoa between October 15th and November 5th, 2011.

Jordan pleaded not guilty in May of 2012 and was released on bond.

White said despite his ADA’s efforts to keep Jordan in custody he was allowed to go free.

“Once a person has been found guilty, their bond is automatically revoked, but he (Jordan) left the courthouse after being convicted of child molestation,” White said. “He was allowed to remain out even though he was convicted by a jury of his peers.”

Under the terms of his release, Jordan is not allowed to have contact with the victim or the victim’s family.

He is also not allowed to leave the area or the state, nor to possess or use any sort of firearm, weapon, alcohol or prescription drugs.

Additionally, Jordan must make the Franklin County Sheriff’s Office aware of any change of address.

So far, no sentencing date has been set.
