Next Hearing Date Set in Wilbros Civil Suit

A new hearing has been set in the Wilbros civil suit case in Stephens County.

Judge Robert Adamson has called in attorneys for both sides for a hearing next Friday, October 16, at 9:30 a.m. in the Stephens County Government Building in downtown Toccoa.

Stephens County Attorney Brian Ranck says that the hearing has multiple purposes.

According to Ranck, the hearing is on a motion filed by attorneys for Wilbros and other defendants for summary judgment, as well as on pending discovery motions.

Also, attorneys for Wilbros and the other defendants are trying to get Joe Wilbanks and other entities besides Wilbros dismissed from the lawsuit and have filed a motion to do that.

Stephens County government and other entities are suing Wilbros, along with Joe Wilbanks, Environmental Resource Concepts, LLC and Wilcorp over the odor associated with the Rose Lane facility.

The last time these sides appeared before Judge Adamson in connection to this case, the judge issued an order that, among other things, called on Wilbros to immediately stop receiving, accepting, or transporting to its Toccoa site any solid or liquid waste materials for treatment, storage, release, field application, or any other purpose until further order of the court, as well as stopping all composting processes at the Toccoa site on Rose Lane.
