Still No Wilbros Appeal of Last Week’s Ruling

There is still no word of an appeal by Wilbros of last week’s ruling by an administrative law judge upholding the Environmental Protection Division’s decision to revoke solid waste and wastewater permits from the Rose Lane facility at the center of an odor controversy in Stephens County.

Stephens County Attorney Brian Ranck said that as of Tuesday, no appeal had been formalized.

Last week, Administrative Law Judge Ronit Walker ruled that the EPD had proven that Wilbros had, in some instances, violated its Solid Waste Handling Permit and its wastewater discharge permit.

As a result, Judge Walker said the EPD was justified in revoking those permits.

Ranck said the revocation of those permits means that Wilbros is not, at this point, allowed to accept any waste under the authority of those two permits that the EPD has taken away.

Furthermore, Wilbros would also have to file a separate motion asking for the EPD’s order to be put on hold while any appeal is heard on the ruling from the administrative law judge.

The decision by the administrative law judge can be appealed in either Fulton County or Stephens County.

There is no word on how long Wilbros has to appeal the ruling by Judge Walker.
