Additional indictments from the Stephens County Grand Jury

The Grand Jury recently handed down indictments in Stephens County Superior Court.

Jody James Carter and Miranda Denise Whitworth were indicted on the charge of burglary in the second degree.

According to the indictment, the charge stems from an incident that occurred on August 8, 2019, when the pair allegedly entered 112 Eagle Claw Ct, in Martin with the intent to rob the residence.

Daniel Shane Isbell was indicted for burglary in the first degree.

The charge stems from an incident that occurred on November30, 2019, when Isbell allegedly entered the residence at 249 Hillcrest Drive, in Toccoa, with the intent to rob the residence.

Demetrius Sanchez Smith was also indicted recently on charges of trafficking methamphetamine or amphetamine, two counts of trafficking cocaine, three counts of violating the street gang terrorism and prevention act, and tampering with evidence.

The charges stem from incidents that occurred on February 11, 14, and 24, 2022.

According to the indictment, Smith was found to be in possession of 28 grams or more of methamphetamine, 28 grams or more of a mixture with a purity of 10 percent or more of cocaine, and 28 grams or more of a mixture with a purity of less than 10 percent of cocaine.

The indictment also alleges that Smith, being associated with the criminal street gang the Bloods, participated in criminal gang activity of trafficking methamphetamine and cocaine with the intent to maintain his status in the gang.

Additionally, Smith allegedly knowingly destroyed physical evidence by using a toilet, sink, or shower to destroy cocaine in his possession.

Brian Lavestor Murphy was indicted on charges of possession of cocaine with intent to distribute and tampering with evidence.

The charges stem from an incident that occurred on September 18, 2019, when Murphy allegedly was found to be in possession of cocaine with intent to distribute. The indictment alleges that Murphy also attempted to destroy or conceal physical evidence.

Lastly, the grand jury indicted Stephanie Danae Phagan on charges of aggravated assault and terroristic threats. The charges stem from an incident that occurred on July 5, 2022, when Phagan allegedly assaulted Roger Dale Gloss with a knife and threatened to murder Gloss.
